EVERYHOME – TERMS & CONDITIONS OF SALE

1. About Us

These Terms & Conditions govern the sale of goods by EveryHome UK LTD (“we”, “us”, “our”).
By placing an order through our website, you agree to be legally bound by these Terms.

These Terms do not affect your statutory rights under the laws of England and Wales.


2. Product Nature (IMPORTANT)

Most products sold by EveryHome are made-to-measure and manufactured to your exact specifications.

By placing an order, you confirm:

  • All sizes, options, and configurations are correct
  • You understand the product is bespoke and cannot be resold

3. Order Acceptance & Contract Formation

  • Your order constitutes an offer to purchase
  • A legally binding contract is formed only when:
    • Payment has been received, and
    • Order confirmation has been issued

We reserve the right to:

  • Cancel or refuse any order
  • Correct pricing or listing errors
  • Substitute materials where necessary (with equal or higher quality)

4. Pricing & Payment

  • All prices are in GBP (£) and include VAT (where applicable)
  • Payment must be made in full at checkout
  • Prices may change at any time prior to order confirmation

5. Made-to-Measure & Cancellation Rights

Bespoke Products

Under the Consumer Contracts Regulations 2013, made-to-measure goods are exempt from cancellation rights.

Once production has started:

  • Orders cannot be cancelled, changed, or refunded
  • This includes incorrect sizes ordered by the customer

Standard (Non-Custom) Products

  • 14-day cancellation period applies
  • Items must be unused and in original packaging

6. Measurement Responsibility (CRITICAL CLAUSE)

Customers are solely responsible for measurements provided.

EveryHome is not liable for:

  • Incorrect sizes ordered
  • Fitting issues due to measurement errors

We strongly recommend:

  • Following our measuring guides
  • Ordering fabric samples before purchase

7. Colour, Fabric & Batch Variation

  • Colours shown online are representative only
  • Variations may occur due to:
    • Screen settings
    • Fabric dye batches
    • Lighting conditions

Repeat orders are not guaranteed to match previous batches exactly.


8. Delivery Terms

  • Delivery timeframes are estimates, not guarantees
  • Delays may occur due to manufacturing or courier issues

Delivery is considered complete when:

  • Goods are delivered to the address provided
  • Left in a safe place or with a neighbour (if authorized)

Important:

  • Do not book installers until goods are received and checked
  • Risk transfers to the customer upon delivery

9. Damages, Faults & Claims

All claims must be reported within 2 days of delivery.

You must provide:

  • Photographic evidence
  • Order details

We will, at our discretion:

  • Repair
  • Replace
  • Remake the item

We do not offer refunds where a repair or replacement is appropriate.


10. Warranty

All products include a 12-month manufacturer’s warranty covering defects in materials or workmanship.

This excludes:

  • Wear and tear
  • Misuse or accidental damage
  • Incorrect installation
  • Environmental factors (sunlight, moisture, etc.)

11. Installation & Use

  • Products must be installed in accordance with instructions
  • All blinds must comply with UK child safety regulations once installed

EveryHome is not liable for:

  • Incorrect installation
  • Failure to follow safety guidance

12. Spare Parts & Compatibility

Where spare parts are purchased:

  • Compatibility is the customer’s responsibility
  • We cannot guarantee fit with non-EveryHome systems

13. Limitation of Liability

To the fullest extent permitted by law:

EveryHome shall not be liable for:

  • Indirect or consequential losses
  • Loss of profit, business, or opportunity
  • Installation or third-party costs

Our total liability shall not exceed:
the value of the goods supplied


14. Chargebacks & Disputes (STRONG CLAUSE)

By placing an order, you agree:

  • Not to initiate a chargeback without first contacting us
  • That made-to-measure items are non-refundable
  • That production begins shortly after ordering

We reserve the right to:

  • Contest unjustified chargebacks with evidence
  • Recover associated costs where claims are fraudulent

15. Force Majeure

We are not liable for delays or failure caused by events outside our control, including:

  • Supply chain disruption
  • Courier delays
  • Manufacturing issues

16. Intellectual Property

All content, images, and branding remain the property of EveryHome.

Unauthorised use is strictly prohibited.


17. Privacy & Data Protection

We process personal data in accordance with UK GDPR.

Your data is used for:

  • Order fulfilment
  • Delivery
  • Customer service

We do not sell or share your data with third parties for marketing.


18. Governing Law

These Terms are governed by the laws of England and Wales.
